Terms of use

Navzeno is beta software. The map and the routes come from community data and can be wrong — signs, closures and your own judgement always come first.

These terms cover the Navzeno app on every platform it runs on, and the web site at navzeno.com. Using either means accepting them. They are written to be read rather than to be skipped; the section that matters most is the navigation one.

Beta software, provided as it is

Navzeno is in beta. It is incomplete, it has bugs we know about and bugs we do not, and features appear, change and occasionally disappear between releases. The features page marks what is built and what is planned; treat anything not listed as built as not built.

The software and the map data are provided “as is” and “as available”, with no warranty of any kind — no promise that it is fit for a particular purpose, that it is accurate or complete, that it will be available, or that it will not lose data. We are not required to keep any region file, feature or version available, though we will not remove one for no reason.

Read this part.

The map, the search results and the routes Navzeno produces are generated automatically from community-contributed data. That data may be wrong, incomplete or out of date, in ways that matter:

  • A road may not exist, may be private, seasonal, closed, washed out, or gated.
  • A one-way street, weight limit or turn restriction may be missing from the data, so a route may ask you to do something illegal or impossible.
  • A ferry may not run in the season you are travelling. A bridge may be out.
  • A campground, fuel station or water point may have moved or closed.
  • Surfaces, widths, clearances and grades are frequently unrecorded. Navzeno does not avoid low bridges or weight-restricted structures, and you must not rely on it to.
  • A route is a suggestion generated from a map, not an assessment of whether the journey is safe for you, your vehicle or the conditions.

Therefore, and without exception:

  1. Road signs, signals, barriers, closures and the instructions of police and road authorities always take precedence over anything the app shows or says. Where they disagree with Navzeno, Navzeno is wrong.
  2. The driver is responsible for the vehicle. Obey the law where you are driving, including the law about handling a phone. Do not operate the app while the vehicle is moving; set the route before you go.
  3. Watch the road, not the screen. Voice guidance exists so you do not have to look at it.
  4. Judge the conditions yourself. Weather, ice, water, wildlife, darkness, fatigue, your vehicle’s capability and your own are yours to assess. The app knows none of them.
  5. Not for emergency use. Do not depend on Navzeno to summon or reach help. Call your local emergency number. In the backcountry, carry a means of communication that does not depend on a phone network, tell someone your plan, and carry a paper map and a compass. An offline map is a good backup; it is not a substitute for preparation.
  6. Not for aviation or marine navigation. Navzeno is a road, trail and land-use map. It is not a nautical chart or an aeronautical chart, it has no soundings, no hazards to navigation, no airspace and no obstacle data, and it must not be used to navigate an aircraft or a vessel.

Map data and its licence

The map, search and routing data in every region file is derived from OpenStreetMap and is used under the Open Database Licence 1.0. Attribution — ”© OpenStreetMap contributors” — travels with that data and with anything you make from it. The full notice, what a region file is, and where the data comes from are on the attribution page, which forms part of these terms.

The Navzeno name, logo and the app itself are ours and are not covered by that licence. The press kit says how the marks may be used.

Using the app and the site

You may install and use Navzeno on devices you control, for personal or business travel, and you may keep the region files you download for as long as you like.

You may not:

  • reverse engineer, decompile or tamper with the app, except where the law where you live says you may despite this clause;
  • redistribute a region file as though it were your own data, or strip the OpenStreetMap attribution from anything derived from it;
  • use automated means to hammer the map host, or download the catalogue at a rate that degrades it for other people;
  • use the app or the site to break the law, to harass anyone, or to help someone else do either;
  • represent Navzeno as endorsing, certifying or verifying any route, road or place.

We may block access to the map host from a client that is causing a problem, and we may stop distributing a region file. Neither requires notice, though we would normally give it.

Purchases

Nothing is for sale today. The app is free while it is in beta, and no payment is taken anywhere in it or on this site. Any prices shown on the pricing page are what we intend to charge at launch, not an offer.

When paid map packs or subscription tiers are offered, their terms — what you are buying, for how long, on what devices, and how refunds work — will be added here and shown to you before you pay. Purchases made through an app store are also subject to that store’s own terms and its refund process.

Limitation of liability, in plain words

You use Navzeno at your own risk. To the fullest extent the law allows:

  • We are not liable for anything that happens because the map or a route was wrong, missing, out of date, or because the app failed, crashed or was unavailable. That includes getting lost, arriving late, taking a road you should not have, damage to a vehicle, lost data, and losses of business, profit or opportunity.
  • Our total liability to you, for everything, is limited to the amount you have actually paid us in the twelve months before the claim — which today is nothing.

Some jurisdictions do not allow a warranty or a liability to be excluded to that extent. Where that is so, these terms apply as far as the law permits and no further, and nothing here removes a right you have that cannot be removed — including, in Canada, your rights under applicable consumer protection legislation.

Nothing in these terms excludes liability for death or personal injury caused by our negligence, or for fraud.

Changes to these terms

We may update these terms as the product changes. The date at the top is when they last changed. Continuing to use the app or the site after a change means accepting the updated terms; if you do not, stop using them and delete the app.

Governing law

These terms are governed by the laws of the Province of Ontario, Canada and the federal laws of Canada that apply there, and the courts of Ontario have jurisdiction — without affecting any right you have to bring a claim where you live under the consumer law that applies to you.
